Private Landfill Developers, North Bay and Earthworks, Inc. are actively pursuing an opportunity to develop a mega-landfill on leased Cortina Indian Land without any oversight or permitting by California or County Environmental and Public Safety Regulations.

How??

How does allowing cheaper dumping for private for-profit companies encourage and promote better US recycling and waste management plans and efforts?

» How will the US Environmental Protection Agency and the Bureau of Indian Affairs (BIA) enforce, monitor and protect the Indian Lands held in trust by the BIA.

» How will  our water  and air know Cortina Rancheria's political boundaries?  Who is liable for contamination both on and off-site? 

»Until the US Government can guarantee our environmental health and safety for all, we urge that the private landfill developers, CORTINA MEGA-LANDFILL project to be built on the the Cortina's  Rancheria and homeland- be stopped!!!
 

Cortina's Plan!
Description of  Proposed Cortina Landfill Project dated September 17, 2007 by Waste Management Division-United States Environmental Protection Agency 

The proposed (Cortina) Class III landfill will include composting, bioremediation, and materials recovery facilities, and will cover approximately 213 acres of a 443-acre lease.  The total acreage of the Reservation is 640 acres.  The total capacity of the landfill is estimated to be 19 million cubic yards, a relatively large landfill.

What (EPA) Is Doing? 

On August 27, (2007) ‘flexibility requests were submitted to the Tribe by the developer for a geo-composite clay liner (GCL) alternative liner and a seismic impact zone exemption.  It is not clear at this point if a supplemental EIS will be required for the flexibility requests.  Other permits requests required from EPA for the project include a Title V operating permit for air emissions, NPDES permits for construction and operation, and a CWA Section 404 permit (issued by the U.S. Army Corps of Engineers) for placement of fill.’
